These Terms & Conditions form a binding agreement between you, or the organization you represent, and PostBrix for access to and use of PostBrix. By creating an account, starting a trial, making a payment, exporting templates, or using any PostBrix service, you agree to these terms in their entirety.
PostBrix provides a cloud-based email builder and workflow platform for creating, editing, previewing, storing, exporting, and managing responsive email templates, digital assets, and related project data. Features may include AI-assisted content generation, reusable components, template exports, test sends, analytics, and team collaboration.
- ✓You must be at least 18 years old or the age of majority in your jurisdiction to use paid PostBrix services.
- ✓You must provide accurate account, billing, and tax information and keep it updated.
- ✓You are responsible for safeguarding your login credentials and for all activity under your account or workspace.
- ✓For team workspaces, the Workspace Owner is fully liable for the actions, compliance, and billing obligations of all invited members.
- ✓You must promptly notify us of unauthorized access or suspected security incidents.
- ✓You are responsible for the legality, accuracy, permissions, and compliance of all templates, images, copy, links, uploaded assets, and recipient data you use with PostBrix.
- ✓You must strictly comply with our Acceptable Use Policy (AUP).
- ✓You must comply with applicable email, privacy, advertising, anti-spam (e.g., CAN-SPAM, GDPR), intellectual property, and consumer protection laws.
- ✓You must not use PostBrix to create phishing content, malware, deceptive campaigns, illegal material, or content that infringes third-party rights.
- ✓Export Control & Sanctions: You represent that you are not located in, under the control of, or a national or resident of any country embargoed by the US, EU, or India, nor are you on any sanctions list (e.g., US Treasury Department’s list of Specially Designated Nationals).
- ✓Paid plans, renewals, and add-ons are charged according to the price and billing period shown at checkout.
- ✓Subscriptions renew automatically. Please review our Subscription & Cancellation Policy for full details on renewals and how to cancel.
- ✓Online payments are processed securely through Razorpay or Paddle. PostBrix does not store full credit card numbers.
- ✓Paddle acts as the Merchant of Record for all international orders and handles relevant global tax compliance.
- ✓Prices are exclusive of GST and other applicable taxes unless stated otherwise. You are responsible for any local taxes that may apply to your purchase.
Refunds and cancellations are governed by our Refund Policy and Subscription Policy. You should review these policies before purchasing a paid plan. Filing fraudulent chargebacks will result in permanent account termination.
You retain ownership of templates, content, assets, and data you upload or create in PostBrix. You grant PostBrix a limited, worldwide, non-exclusive license to host, process, reproduce, transmit, display, and back up your content solely to provide, secure, support, and improve the service.
PostBrix, its software, interfaces, workflows, brand assets, documentation, and underlying technology are owned by PostBrix or its licensors. You may not copy, reverse engineer, resell, sublicense, or misuse any part of the service except as expressly allowed by these terms.
We welcome vulnerability reports from security researchers. If you discover a potential security issue, you must report it confidentially to privacy@postbrix.com. You must not publicly disclose the vulnerability until we have had a reasonable timeframe to remediate the issue. Exploiting vulnerabilities, unauthorized data access, or disrupting our services is strictly prohibited and constitutes a breach of these Terms.
PostBrix is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not guarantee that the service will meet your specific requirements, be free from vulnerabilities, or that all email clients will render generated templates identically.
To the maximum extent permitted by applicable law, PostBrix, its founders, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, data, goodwill, business interruption, or email campaign performance. PostBrix is not responsible for the accuracy or legality of content generated by AI, sourced from third-party media providers, or created by you. Our maximum aggregate liability for all claims relating to the service will not exceed the total amount you paid to PostBrix in the three (3) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless PostBrix and its affiliates, officers, directors, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these terms, or any content you create, upload, or transmit through PostBrix.
We may suspend or terminate access without notice or refund if you breach these terms, violate the Acceptable Use Policy, fail to pay fees, create legal or security risk, or if required by law or our payment providers. Sections relating to payment, ownership, confidentiality, disclaimers, indemnity, limitations, and dispute resolution survive termination.
PostBrix shall not be liable or responsible for any failure or delay in fulfilling its obligations under these terms when such delay or failure is caused by acts or events beyond our reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, strikes, severe infrastructure failures, denial-of-service attacks, cloud provider outages, or governmental regulations.
These terms are governed by the laws of India. Any dispute, claim, or controversy arising out of or relating to these terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Ahmedabad, Gujarat, India, before one arbitrator. The arbitration shall be administered in English. Subject to this arbitration clause, courts located in Ahmedabad, Gujarat, India will have exclusive jurisdiction over any litigation arising out of or relating to this agreement.
AI-generated output is provided "as is" without any warranty of accuracy, legality, or non-infringement. Due to the nature of machine learning, AI may generate inaccurate, misleading, or copyrighted material. You are solely responsible for reviewing and verifying the accuracy, legality, and appropriateness of all content generated by AI features before use. PostBrix explicitly disclaims any liability for copyright, trademark infringement, or factual inaccuracies arising from your use of AI-generated content or stock photos from Unsplash/Pexels.
